1) FCMS agrees in consideration of the fee to make available to the user FCMS squawk and other services throughout the term.
2) The services shall usually be operational during normal operation hours but FCMS shall not be liable in the event of the non-transmission interruption or failure of the services.
3) FCMS shall not be liable for any errors on the services or for the omission of any event.
4) FCMS makes no representation as to the accuracy or completeness of any information provided via its’ services and gives no warranty, either express or implied as to the quality or fitness for a particular purpose of the services provided. Any reliance upon the services is at the Users own risk. In the light of the above the User agrees to hold FCMS harmless and fully indemnify FCMS, its officers and employees in respect of any claim or action in respect of any economic loss or consequential harm or loss howsoever or whensoever arising consequent upon the use of FC services.
5) This licence is personal to the user and cannot be assigned or transferred without express written permission from FCMS.
6) This licence permits the user singular access to the services. Any replication, duplication or copying or any or all of the services is contrary to the intent of this agreement and give rise to immediate termination without redress.
7) The user shall not disclose or permit their access to be used by anybody else and shall report any disclosure or unauthorised use to FCMS immediately.
8) FC reserves the right to withdraw or suspend access to any of its services at anytime without giving cause or reason. Upon withdrawal the User shall be entitled to a pro-rata refund of a portion of the paid fee.
9) Should any provisions of the agreement be found to be unenforceable the remainder shall still be in effect.
10) This agreement shall be governed and construed in accordance with English Law and the parties hereto submit to the non-exclusive jurisdiction of the English courts.
11) The fee is due on the commencement date and monthly thereafter. In the event that FCMS does not receive the fee FCMS will suspend the users access to all services and implement a “Late Payment Fee of £250.00”.
